SUBJECT: South Carolina Department of Mental Health Client Rights Manual
I. The Purpose of this directive is to establish Department of Mental Health policies and standard practices in substantive areas pertaining to client rights. The Department's policies and standard practices are set forth in the "South Carolina Department of Mental Health Client Rights Manual" and the contents of that manual are incorporated by reference into this directive as official policy and procedure.
II. The "South Carolina Department of Mental Health Client Rights Manual" applies to all Department of Mental Health inpatient facilities and programs with the exception of Forensic Units and the Behavioral Disorders Treatment Program. Forensic Units and the Behavioral Disorders Treatment Program shall implement written policies and procedures to address the rights of residents in those programs. The Manual applies to outpatient programs to the extent that it is applicable.
III. The "South Carolina Department of Mental Health Client Rights Manual" is a part of the Department's Client Advocacy Program. Other parts of the Client Advocacy Program include the "Client Grievance Review Procedure", which sets forth procedures for the review and resolution of client grievances and the education and orientation of staff and clients concerning rights and established policies and procedures.
IV. The "South Carolina Department of Mental Health Client Rights Manual" shall be readily accessible to all personnel as well as to clients who may desire additional information.
This directive rescinds and supersedes SCDMH Directive No. 551-80 entitled "South Carolina Department of Mental Health Patient Rights Manual."
