PER DIEM

 

1. Per Diem - Legislators

Legislators are not eligible to draw Per Diem for committee meetings on days when the General Assembly is in session.

"No per diem may be paid to any person from more than one source for any calendar day."

Refer to Per Diem - Boards Commissions and Committees for the regular per diem rate established by the General Appropriation Act for members of boards and commissions.

2. Per Diem - Election Workers

"Managers and clerks of state and county elections shall receive a per diem of $35.00; but managers shall not be paid for more than two days for any election and clerks for not more than three days for any election. The Commission may adjust the per diem of $35.00 for the managers and clerks of the statewide election to a higher level only to the extent that the appropriation for the statewide election is sufficient to bear the added cost of increasing the per diem and the cost of the statewide election."

3. Per Diem - Boards, Commissions and  Committees


"The per diem allowance of all boards, commissions and committees shall be at the rate of Thirty-five Dollars ($35.00) per day."

Any board, commission or committee members receiving per annum payments are not eligible for per diem.

4. Per Diem - State Employees


"No full-time officer or employee of the State shall draw any per diem allowance for service on such boards, commissions or committees."

Circuit Judges are State employees and are not eligible for per diem.

5. Per Diem - Special Judges

"The special judge shall be allowed for his services, per diem of one hundred dollars ($100.00) and his necessary expenses and the same per diem for not exceeding five days for the preparation of his decrees." The Judicial Section of the current Appropriations Act states that in the payment of funds from "Contractual Services," and "Administrative Fund," that no special judge shall be paid for more than a two-week term within a fiscal year except that this restriction will not apply in case of an on-going trial. 6. Per Diem - Board of State Canvassers

"$100.00 additional compensation per day may be paid to each member of the Board of State Canvassers up to a total of fifteen days (15) that may be required for hearings held by the members of the Board of State Canvassers."

Any board, commission or committee members receiving per annum payments are not eligible for per diem.
